Terms and conditions

The terms that apply to every quotation, order and delivery from Buitenkeukendeal B.V.

Version of 1 January 2021 (last amended in April 2026).

Article 1 - Definitions

In these general terms and conditions, the following definitions apply:

  • Buitenkeukendeal: Buitenkeukendeal B.V., established in Almelo and registered in the Trade Register of the Chamber of Commerce (KvK) under number 88770338.
  • Customer: The natural person or legal entity with whom Buitenkeukendeal enters into a contract.
  • Parties: Buitenkeukendeal and the customer together.
  • Consumer: A customer who is also a natural person acting as a private individual (not in the course of a profession or business).

Article 2 - Applicability

  1. These general terms and conditions apply to all quotations, offers, work, orders, contracts and deliveries of services or products by or on behalf of Buitenkeukendeal.
  2. Deviations from these terms and conditions are only valid if the parties have expressly agreed to them in writing.
  3. The applicability of any general terms and conditions or purchasing conditions of the customer or third parties is expressly rejected.

Article 3 - Prices

  1. All prices stated are in euros, including VAT and excluding any other costs such as administration costs, levies, and travel, shipping or transport costs, unless expressly stated otherwise.
  2. Buitenkeukendeal may change the prices of products or services at any time.
  3. Unforeseen increases in the cost price of products or parts thereof, which Buitenkeukendeal could not foresee when the contract was concluded, may give rise to a price increase.
  4. As a consumer, you have the right to dissolve the contract in the event of a price increase (unless the increase results from a statutory provision).

Article 4 - Samples and Models

If the customer has received a sample or model, it serves solely as a general indication of the nature of the product. The parties may expressly agree that the product actually to be delivered will correspond exactly to it.

Article 5 - Payment and Default

  1. Payment must be made within the agreed term. If timely payment is not made, the customer is in default by operation of law from the date of default:
  • Non-commercial transactions: statutory interest of 2% per month.
  • Commercial transactions: statutory interest of 8% per month.
  • For this purpose, part of a month is counted as a full month.
  1. In the event of default, the customer also owes the statutory extrajudicial collection costs and any compensation for damages.
  2. Buitenkeukendeal may suspend its obligations for as long as payment has not been made.
  3. In the event of liquidation, bankruptcy, attachment or suspension of payments of the customer, all claims become immediately due and payable.
  4. If the customer refuses to cooperate in the performance of the contract, they remain fully obliged to pay the entire agreed price.

Article 6 - Right of Reclamation

  1. As soon as the customer is in default, Buitenkeukendeal may invoke the right of reclamation with regard to delivered products that have not been paid for.
  2. This is done by means of a written or electronic notice.
  3. Following such notice, the customer must return the products concerned immediately. The transport and return costs for this are borne by the customer.

Article 7 - Right of Withdrawal (for Consumers)

  1. Consumers may dissolve an online purchase within a cooling-off period of 14 days without giving any reason, provided that:
  • The product is unused and undamaged.
  • It is not a custom-made product (made specifically for the consumer).
  • The seal of data carriers (such as CDs/DVDs) is intact.
  • It does not concern excluded products such as perishable goods, individual magazines or urgent repairs.
  1. The cooling-off period of 14 days commences on the day after the consumer has received the last product or part of the order.
  2. A return can be registered via `info@buitenkeukendeal.be` (optionally using the model form on the website). The product must be returned within 14 days of this notification.
  3. Diminished value: If the product or the packaging is damaged to a greater extent than necessary to assess the product, this diminished value may be charged to the consumer.
  4. Refund: Buitenkeukendeal will refund the full order amount (including any initial shipping costs) within 14 days of the return notification, provided that the product has been received back in good order or conclusive proof of dispatch has been provided. The costs of returning the product are borne by the consumer.

Article 8 - Suspension, Right of Retention and Set-off

  1. Suspension & set-off: Non-consumers hereby waive the right to suspend performance or to set off debts.
  2. Right of retention: Buitenkeukendeal may retain products of the customer until all outstanding invoices have been paid (including those arising from previous contracts). Buitenkeukendeal is never liable for any damage resulting from this.

Article 9 - Retention of Title

  1. All products delivered remain the property of Buitenkeukendeal until the customer has fully met all of their payment obligations.
  2. Until that time, the customer may not pledge, sell or encumber the goods.
  3. If Buitenkeukendeal invokes the retention of title, the contract is deemed to have been dissolved and Buitenkeukendeal is entitled to compensation for damages and loss of profit.

Article 10 - Delivery and Delivery Time

  1. Delivery takes place while stocks last, ex Buitenkeukendeal's location, unless otherwise agreed. Online orders are delivered to the address specified by the customer.
  2. Delivery times stated are indicative and, if exceeded, do not give rise to a right to dissolution or compensation, unless otherwise agreed in writing.
  3. The delivery time commences as soon as the ordering process has been fully completed and a confirmation has been issued.
  4. If the customer does not cooperate with the delivery in a timely manner (creditor's default), late delivery cannot be held against Buitenkeukendeal.

Article 11 - Transport, Packaging and Storage

  1. Transport costs are borne by the customer, unless otherwise agreed.
  2. Broken or damaged packaging must be noted on the consignment note/by the carrier immediately upon receipt. Failing this, Buitenkeukendeal is not liable for any damage.
  3. If products are collected or accepted later than planned, the risk of loss of quality and any additional storage costs are borne entirely by the customer.

Article 12 - Assembly and Installation

Although Buitenkeukendeal exercises the utmost care in assembly and installation work, it bears no responsibility for such work, except in the event of intent or gross negligence.

Article 13 - Warranty and Transfer of Risk

  2. Normal wear and tear, damage caused by accidents, unauthorised modifications, negligence or improper use are excluded from the warranty.
  3. The risk of loss of or damage to the products passes to the customer at the moment they are legally and/or actually delivered.

Article 14 - Complaints and Disputes

  1. Complaints about products or services delivered must be reported to Buitenkeukendeal in detail as soon as possible – but no later than 1 month (for consumers, within 2 months) after discovery.
  2. If a complaint cannot be resolved by mutual consultation and the online shop is affiliated with WebwinkelKeur, the consumer may contact WebwinkelKeur for free mediation (www.webwinkelkeur.nl). Should this not lead to a solution, the dispute may be submitted to the independent disputes committee of WebwinkelKeur, whose decision is binding.

Article 15 - Liability

  1. Buitenkeukendeal is only liable for direct damage caused by intent or deliberate recklessness.
  2. Liability for indirect damage (such as consequential damage, loss of profit, lost savings or business interruption losses) is excluded at all times.
  3. If Buitenkeukendeal is liable, this liability is limited to a maximum of the amount paid out by its liability insurance or (in the absence thereof) to the invoice amount to which the liability relates.
  4. Any right to compensation lapses in any event 12 months after the event from which the liability arises directly or indirectly (without prejudice to Article 6:89 of the Dutch Civil Code).

Article 16 - Force Majeure

  3. Applicable law and competent court: All legal relationships between the parties are governed exclusively by Dutch law. Any disputes will be submitted to the competent Dutch court in the district in which Buitenkeukendeal is established.
